Is Kalshi Legal in California?

It’s complicated. Kalshi operates as a federally regulated “prediction-market exchange,” not a traditional sportsbook and because of that, the company claims it can legally offer event-outcome contracts across all U.S. states, including California.  But the legality of using Kalshi in California remains unsettled, and regulators and courts are actively challenging whether its products amount to gambling under state law.

Why Kalshi Claims It’s Legal Nationwide

  • Kalshi is licensed and regulated by the Commodity Futures Trading Commission (CFTC), which oversees derivatives, futures, and other event-contract markets.

Why Kalshi Faces Legal Risk in California

Despite Kalshi’s federal license, state regulators and tribal gaming interests argue that its sports- and event-based contracts should be regulated as gambling under California law. In late 2025, at least one lawsuit brought by tribes challenging Kalshi’s access to Indian lands in California was denied — the court found that, as a CFTC-regulated exchange, Kalshi’s contracts were not “bets” under Internet-gambling laws.

Still, that ruling doesn’t settle the broader argument for all of California. Other states have already banned or restricted Kalshi for offering sports-event contracts, and courts elsewhere have questioned whether federal derivatives law should preempt state gambling laws.

Because sports betting itself remains illegal statewide in California — the state rejected legalization propositions in 2022, and no new statewide regulation has passed since — any platform that resembles a sportsbook remains under scrutiny.

What This Means for You (If You’re in California)

  • Using Kalshi is not risk-free.While the company claims a legal defense under federal regulation, the state’s gambling authorities may take a different view, especially if the contracts resemble traditional bets.

Bottom Line

Whether Kalshi is “legal” in California right now depends on ongoing court battles not just federal licensing. For the moment, its federal regulation under the CFTC gives it a plausible argument for nationwide operation. But because California continues to prohibit traditional sports betting, many state regulators, tribal interests, and courts are challenging Kalshi’s model.
